General Rules for Dutiable / Non Dutiable Royalties
- Royalty Payments and License Fees for patents covering processes to manufacture are generally dutiable.
- Paid to Create / Manufacture an item
- Royalty Payments and License Fees (paid to third parties in the USA) for copyrights and trademarks are typically considered to be selling expenses and are not dutiable.
- Paid to Sell an item
