Silver Jewelry – A pair of earring counts as 2 pieces

 

Precious Metal Beads:  The heading of 7113 provides for “parts thereof” so beads would be rated under the same HTS #s as Silver jewelry 7113.11.2000 or 7113.11.5000.

 

Base metal – base metal covers all types of metal

 

Epoxy – Epoxy is typically a coating over another material and the classification is normally the material under the epoxy. 

 

Silicone – there are binding rulings that place silicone in plastic as opposed to rubber.  You should verify the material to ensure it is correct. 

 

Jewelry set with Precious or Semi-Precious stones into a Precious Metal Jewelry are rated as the Precious Metal in this section.

 

Precious or Semi-Precious Stones set into a base metal can be rated under HTS 7116 section. 

 

The only difference between “sterling silver” and “silver” is the purity.                 

 

If you mark your silver as “925 silver” it must actually be 925 silver.  You do not have to write anything regarding 925 silver on the commercial invoice – just stating genuine silver is fine.

 

Clad with Precious Metal – Clad is an electronically processed jewelry vs. plaiting.  Plaiting is not considered clad.  Clad is not very common at all.  Any time 7113.20 is to be used Liberty recommends getting an advisory first.

Mother of Pearl is not a pearl it is a shell.

 

Austrian Crystal is glass / lead crystal glass and rated 7117.90.9000.

 

Cubic Zirconia are used to imitate diamonds and are considered by US Customs to be a synthetic precious gemstone and are allowed under 7116.  (Cubic Zirconia loose, cut but not set, and suitable for use in the manufacture of jewelry is rated as 7104.90.1000 @ Free)

 

Spinel Stone is also an approved synthetic stone that can be rated under 7116.

 

Please note that glass articles are not synthetic stones (example, a glass imitation cat eye is glass jewelry and not synthetic).

 

Metal necklace extenders are classified as metal jewelry.

 

Metal jewelry covered in textile is an essential character that is in debate.  Most jewelry is rated as per the essential character of the decorative feature.  Slap bracelets are rated as metal because the metal “slaps” around the wrist and creates its form (binding rulings on these).  So bangle bracelets that are covered with textiles could be rated as the textile decorative part or the metal framework.  We are handling case by case but can not confirm 100% without a binding ruling.  Customs has encouraged importers to obtain binding rulings on similar items in order to be accurate.

Note:  There are provisions for jewelry that is valued not over 20 cents per doz.  This information will be provided upon request.

 

Note:  Jewelry of solid precious metal are treated as the precious metal but jewelry that is plated with precious metal are rated under 7117.

 

Note:  There are provisions for religious jewelry – this is for jewelry sold to a religious organization and for jewelry worn during a religious ceremony.  This information can be forwarded upon request.

 

Plastic Jewelry:  The essential character of the jewelry must be plastic.  Since this is a free duty rate it is very important to be accurate.  Customs has been known to request samples.  Errors can “red flag” your company to customs as being “non compliant.”

 

Other Jewelry:  Wood, Mother of Pearl (F&W), Shell (F&W), Glass, and Leather (no F&W).

 

Textile Jewelry:  Textile Jewelry may be rated under 6217 at 14.6% and may require a Visa.   Essential Character is used to make the determination of the rate. 

 

Special Note:  A Flower Pin – where the flower is glues of individual petals as opposed to one piece of fabric and gathered – is rated as the flower under 6703.90.3500 @ 9% (there are no Visa requirement under this provision). 

 

Note:  Alert jewelry used in the medical industry is still jewelry and rated under Chapter 71.

 

Nail Art / gems are classified under 7117 as per Binding Rulings NY H82313 and NY I83825.  Plastic decals go elsewhere. 

 

Note:  Pouches that contain jewelry are considered containers of a kind normally used for that commodity and are therefore not broken out as reusable packaging.
